12 February 2024: CYK partner Jon Felce and Associate Tulsi Bhatia write for Law360 on the English Court’s recent judgment in Border Timbers Ltd v Republic of Zimbabwe, which while upholding registration of an ICSID award, examined the relationship between the ICSID Convention and the State Immunity Act 1978, and notably found that the issue of state immunity is irrelevant to the registration of an ICSID awards.
