12 February 2024: CYK partner Jon Felce and Associate Tulsi Bhatia write for Law360 on the English Court’s recent judgment in Border Timbers Ltd v Republic of Zimbabwe, which while upholding registration of an ICSID award, examined the relationship between the ICSID Convention and the State Immunity Act 1978, and notably found that the issue of state immunity is irrelevant to the registration of an ICSID awards. In August 2023, Mr Ziyavudin Magomedov (a Russian oligarch who was jailed in 2022 for 19 years on fraud and embezzlement charges) filed a US$14 billion conspiracy claim in the Commercial Court alleging that various of his businesses were seized in a conspiracy led by the Russian State. CYK act for Domidias Limited and Mr Andrey Severilov who are defendants to that conspiracy claim, understood to be the largest non-class action claim commenced in the Commercial Court to date.

By Mikhail Vishnyakov and Tusli Bhatia The recent judgment in National Iranian Oil Company v Crescent Petroleum Company International Limited [1] provides useful insight into how a challenge to an arbitration award on the basis that the tribunal lacked jurisdiction (available under section 67 of the Arbitration Act 1996 (“AA 1996”)) can be disposed of via summary judgment, thus avoiding a complete rehearing, when the challenge has no realistic prospect of success.

25 October 2022: CYK is acting for Topalsson GmbH in its litigation against Rolls-Royce Motor Cars Ltd. Topalsson and Rolls-Royce entered into a contract in October 2019 for the development and deployment of a ‘configurator’ for Rolls-Royce’s car models. The configurator was intended to be a piece of software which would allow customers and dealers to customise cars with photorealistic 3D models and in real-time. Rolls-Royce terminated the contract in early 2020 and the parties have brought claims against each other for breach of contract. The case was recently reported in The Telegraph and The Times.

This case dealt with a scenario where US financial sanctions were enforced on a contractual party and a dispute arose over what would amount to a “reasonable endeavour” on behalf of contractual parties to avoid the sanctions preventing performance of the contract.

Welcome to FYI Cooke, Young & Keidan’s newsletter.  This edition’s articles represent the wide range of contentious work we undertake for clients.  We kick off with views from Philip Young on the pressure on practitioners to predict outcomes in commercial litigation.  We also look at the growing number of disputes in the field of medical technology, and examine the ongoing effects of the pandemic on litigation, while taking in the legal impact of cybercrime, international sanctions, and a law dating back to 1614.

In the first of a series of three articles by our team on litigation in the medtech sector, Elizabeth Meade looks at the potential increase in cases of suspected fraud set against the background of the Theranos case in the US.

CYK Partner Philip Young considers the requests made of lawyers to offer probabilistic assessments of the outcome of commercial litigation. He points out the potential hazards, and the role that human biases and assumptions play in both making and interpreting these predictions.  A version of this article will shortly appear in the New Law Journal.
