CYK secures another decisive win for our clients in the Magomedov saga

CYK’s clients successfully challenge the jurisdiction of the English Court

On 17 January 2025, Mr Justice Bright handed down judgment in Magomedov & Ors v TPG Group Holdings (SBS), LP & Ors [2025] EWHC 59 (Comm) finding for CYK’s clients Domidias Limited and Mr Andrey Severilov, in addition to all other Defendants, that the English Court does not have jurisdiction over a US$14 billion alleged conspiracy claim pursued by (amongst others) the beleaguered Mr Ziyavudin Magomedov.

The jurisdiction challenges were heard at a lengthy 9-day hearing in September 2024, and a further 4-day hearing in November 2024, prior to judgment being handed down this month. Both Domidias and Mr Severilov were awarded their costs, Domidias’ costs on the indemnity basis.

This success is hot on the heels of Domidias’ win in March 2024, in which CYK secured reverse summary judgment in respect of contractual claims brought by parties related Magomedov – see here. That triumph came off the back of CYK’s successful defence of an application for a US$8.8bn freezing order against Mr Severilov – see here.

The CYK team comprised of Lydia DanonJulia OgievetskyEmily Davies and Jordan Waldock, alongside the ever impressive counsel team of Blair Leahy KC of Twenty Essex, Nathan Pillow KC and David Peters KC of Essex Court and Donald Lilly (soon to be KC) of 4 Stone Buildings.
