With the start of a new year, developments in the UK sanctions landscape show no signs of slowing down. We anticipate that it will be another busy year for sanctions practitioners, with the continued evolution of the UK sanctions regime. This synopsis captures some of the more recent updates:

On 17 January 2025, Mr Justice Bright handed down judgment in Magomedov & Ors v TPG Group Holdings (SBS), LP & Ors [2025] EWHC 59 (Comm) finding for CYK’s clients Domidias Limited and Mr Andrey Severilov, in addition to all other Defendants, that the English Court does not have jurisdiction over a US$14 billion alleged conspiracy claim pursued by (amongst others) the beleaguered Mr Ziyavudin Magomedov.

12 February 2024: CYK partner Jon Felce and Associate Tulsi Bhatia write for Law360 on the English Court’s recent judgment in Border Timbers Ltd v Republic of Zimbabwe, which while upholding registration of an ICSID award, examined the relationship between the ICSID Convention and the State Immunity Act 1978, and notably found that the issue of state immunity is irrelevant to the registration of an ICSID awards. In August 2023, Mr Ziyavudin Magomedov (a Russian oligarch who was jailed in 2022 for 19 years on fraud and embezzlement charges) filed a US$14 billion conspiracy claim in the Commercial Court alleging that various of his businesses were seized in a conspiracy led by the Russian State. CYK act for Domidias Limited and Mr Andrey Severilov who are defendants to that conspiracy claim, understood to be the largest non-class action claim commenced in the Commercial Court to date.

25 October 2022: CYK is acting for Topalsson GmbH in its litigation against Rolls-Royce Motor Cars Ltd. Topalsson and Rolls-Royce entered into a contract in October 2019 for the development and deployment of a ‘configurator’ for Rolls-Royce’s car models. The configurator was intended to be a piece of software which would allow customers and dealers to customise cars with photorealistic 3D models and in real-time. Rolls-Royce terminated the contract in early 2020 and the parties have brought claims against each other for breach of contract. The case was recently reported in The Telegraph and The Times.
